These Terms of Service ("Terms") govern your use of the website at thetrueformcreative.com and the services provided by TrueForm Creative LLC ("TrueForm," "we," "us," or "our"). By using our website, booking a call, or subscribing to a service, you agree to these Terms.
1. Who we are and what we sell
TrueForm builds and runs AI tools for local service businesses. Our products are the AI Website (a website with an assistant trained on your business, with hosting and a domain included), the AI Receptionist (an AI agent that answers your business phone line, books appointments, and texts callers), and the Review Bot (text-message follow-up that asks your customers for Google reviews). Each product is sold as a subscription, in some cases with a one-time setup fee.
2. Your account and your business
You must be at least 18 and authorized to act for the business you sign up. You agree to give us accurate information about your business (services, hours, service area, pricing rules, calendar, and the numbers we should transfer calls to) and to keep it current. The assistant and the receptionist only know what you tell us and what is on your website.
3. Fees, billing, and setup
- Prices are listed on our pricing page and confirmed in writing before you are charged. Setup fees are due before we start building. Monthly fees are billed in advance on the same day each month.
- There is no minimum term and no contract. You can cancel at any time (see section 8).
- Usage limits (for example, receptionist call minutes) are stated with each plan. If you go over, we will tell you and agree on a plan change or an overage rate before charging more.
- Payments are processed by a third-party processor such as Stripe under that processor's terms. Failed payments pause the service after a reminder.
- We may change prices with 30 days' notice. Changes never apply to a month you have already paid for.
4. AI disclosure and limits
Our products use artificial intelligence, including large language models and AI-generated voice. That means:
- The AI can make mistakes. It can misunderstand a caller or give an answer that is incomplete or wrong. We limit what it is allowed to say (for example, it will not quote prices you have not approved), but we do not guarantee every answer.
- Callers and website visitors are told they are talking to an AI assistant. You may not ask us to remove that disclosure.
- You are responsible for reviewing the information the AI is given, for the bookings and commitments made on your behalf, and for following up with your customers. We are not a party to any transaction between you and your customers.
- Do not use the products for emergency services dispatch, medical or legal advice, or any purpose where an error could cause serious harm.
5. Call recording and transcripts
Calls handled by the AI Receptionist are recorded and transcribed so that you can read what happened and so that we can improve the service. At the start of every call the receptionist tells the caller that the call is with an AI assistant and may be recorded. Because recording-consent laws differ by state, you agree that this disclosure stays on, and you agree not to route calls from jurisdictions where such recording would be unlawful. You can ask us to turn off recording (transcripts will still be produced from the live audio where the law allows).
6. Text messaging (SMS) rules
The AI Receptionist and the Review Bot send text messages to your customers on your behalf. You agree that:
- You will only give us numbers of people who have done business with you or contacted you, and who you have a lawful basis to text (for example, a customer who just had a job done, or a caller who asked for a text back).
- Every message we send includes a way to opt out. Anyone who replies STOP is removed automatically, and you agree not to ask us to text them again.
- Messages are transactional or relationship messages tied to a job, a call, or a review request. We do not send marketing blasts, and you may not use the products for cold outreach.
- Carrier rules (including toll-free verification and 10DLC registration) apply to the numbers we use for you. We register them, and you agree to give us the business details the carriers require.
- You are responsible for complying with the TCPA, the CAN-SPAM Act, and your state laws in how you use these tools.
7. Reviews
The Review Bot sends every customer the same public review link. It does not filter customers by expected rating, and we will not build it to. You agree not to ask us to gate, suppress, or fake reviews. AI-drafted replies to reviews are drafts that you approve before they are posted.
8. Cancellation, and what you keep
- Cancel any time by emailing trueformcreative1@gmail.com. Cancellation takes effect at the end of the current billing period. Our refund terms are in the Refund Policy.
- Your domain is yours. If we registered a domain for you, we transfer it to a registrar account in your name within 14 days of your request, at no charge.
- Your content is yours. Your logo, photos, copy, reviews, call transcripts, and customer data belong to you. On cancellation we give you an export of your content and data on request.
- The site itself.When your AI Website subscription ends, the hosted site and the assistant go offline. On request we provide a static export of your site's pages that you can host elsewhere. The assistant, the booking integration, and our internal tooling are not included in the export.
- Phone numbers we provisioned for you can be ported to you on request, subject to the carrier's process.
- We delete your data from our systems 90 days after cancellation unless the law requires us to keep it longer.
9. Intellectual property
We retain ownership of the platform, the assistant and receptionist logic, prompts, templates, integrations, and any pre-existing tools and code. You receive a license to use them for the duration of your subscription. You retain ownership of your content and data. We may name your business as a customer and show the public parts of your site in our portfolio unless you ask us in writing not to.
10. Third-party services
The products rely on third-party services such as hosting providers, telephone carriers, calendar providers, payment processors, and AI model providers. Those services have their own terms and outages. We choose them carefully but are not responsible for their availability or policies.
11. Acceptable use
You may not use the products to break the law, to harass or deceive anyone, to impersonate another business, to send unsolicited messages, or to collect data you are not entitled to collect. We may suspend a service that is being misused after telling you why.
12. Warranties and disclaimers
We provide the products with reasonable skill and care. Except as expressly stated in these Terms or in our guarantee, the products are provided "as is" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee any number of calls, bookings, reviews, or revenue.
13. Limitation of liability
To the fullest extent permitted by law, TrueForm will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, including losses caused by a missed call, an incorrect answer, a failed booking, or a service outage. Our total liability for any claim will not exceed the fees you paid us in the three months before the claim.
14. Changes to these Terms
We may update these Terms. When we do, we will update the date above and, for material changes, email you at least 14 days before they take effect. Continuing to use the products after that date means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules. Disputes will be handled in the state or federal courts located in Utah, unless applicable law requires otherwise.
